The resulting fragmentation and diffusion of responsibility for defective design among participants undermines one of the principal goals of Design-Build—to accomplish unified or single point of accountability for the design, construction, and performance of the completed project. In the process of evaluating information contained in the RFP (or other procurement solicitation or tender), and in preparing its response or proposal, the Design-Builder may or may not have adequate opportunity to independently verify the adequacy, accuracy, or constructability of the Owner-furnished preliminary design, or the ability to achieve the Owner’s performance specifications.

The Design-Builder should be afforded a reasonable amount of time and a meaningful opportunity to investigate site conditions and review preliminary design and/or site information furnished by the Owner. Efforts by the Owner and/or the Owner’s Engineering Consultant to significantly limit or constrain the Design-Builder’s flexibility and discretion, such as through the imposition of detailed and prescriptive design criteria or performance standards or stringent submittal review and approval requirements, will be perceived by the Design-Builder as an intrusion into the DesignBuilder’s role, which should result in some risk retention to the Owner for the adequacy of final design and subsurface investigation.
